By accessing or using the Smart Story Studio platform (the "Service"), operated by Smart Story Studio Pty Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Smart Story Studio provides a platform for early childhood educators to create curriculum-aligned documentation including daily reports, observations, and progress reports. The Service includes a web portal and an iOS application.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access. One account may not be shared across multiple centres unless on a multi-centre plan.
Free trial: New accounts receive a 28-day free trial. No charges are incurred during the trial period.
Billing: After the trial, subscriptions are billed annually via Stripe. Prices are in Australian Dollars (AUD) and include GST where applicable.
Cancellation: You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
Price changes: We may adjust pricing with 30 days' written notice. Existing subscriptions will honour the current price until the next renewal.
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that violates the privacy or rights of any person
- Attempt to gain unauthorised access to any part of the Service
- Reverse-engineer, decompile, or disassemble the Service
- Use the Service to compete with Smart Story Studio
- Share login credentials with unauthorised individuals
Your content: You retain ownership of all content you upload or create using the Service (observations, reports, photos). You grant us a limited licence to process this content solely to provide the Service.
Our content: The Smart Story Studio platform, including its design, code, branding, and AI models, is our intellectual property. You may not copy, modify, or distribute any part of the platform without written permission.
Generated reports: Reports generated by the Service are owned by your centre. You are responsible for reviewing all generated content before distribution.
Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring you have appropriate consents to enter children's information into the platform, in accordance with your centre's privacy obligations.
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance with reasonable notice. We are not liable for any loss resulting from temporary unavailability.
To the maximum extent permitted by Australian law, Smart Story Studio Pty Ltd is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount paid by you in the 12 months preceding the claim.
Smart Story Studio uses technology to assist educators in creating reports. All generated content should be reviewed by a qualified educator before use. We do not guarantee the accuracy, completeness, or regulatory compliance of generated content. The educator remains responsible for the final report.
We may suspend or terminate your access if you breach these Terms. Upon termination, your data will be retained for 90 days to allow for export, after which it will be deleted.
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
